More and more businesses are opting to sign documents using electronic signatures, allowing the signing process to be conducted remotely. The UK Government has agreed with the Law Commission Report 2019 that electronic signatures are generally acceptable under English Law. Electronic signatures can take various forms, including typing a name into a contract, electronic pasting of a signature, accessing a contract through a web-based e-signature platform, and clicking an "I accept" button. The Law Commission confirmed that an electronic signature is capable of being used to validly execute documents, including where there is a statutory requirement for a signature, provided that the person signing intends to authenticate the document and any formalities are satisfied. The UK Government has endorsed the Law Commission's conclusion, stating that formal primary legislation is not necessary to reinforce the legal validity of electronic signatures.
