The organization argues that the effective date of the legislation is not retroactive, but rather mirrors the date the IRS warned bad actors to halt their abusive transactions, and that changes to the effective date would only protect the profiteering of these actors. Despite efforts by federal agencies, these abuses continue, and Congress needs to pass the Act to shut down these transactions and safeguard the taxpaying public, while ensuring the federal tax incentive for land conservation remains available for genuine philanthropists.
