Professor Eric Biber testified before the US House of Representatives, Committee on Natural Resources, Subcommittee on Federal Lands, on June 3, 2015, regarding the Forest Resilience Discussion Draft. He emphasized three key principles for addressing environmental challenges: public participation, using up-to-date scientific information, and court accountability.

Biber argued that the Discussion Draft fails to satisfy these principles, particularly by limiting public participation through categorical exclusions under the National Environmental Policy Act (NEPA). He cited examples of how public participation can improve agency decisionmaking, such as under the Endangered Species Act, where citizen petitions can lead to better listing decisions.

The Discussion Draft's provisions, including sections 103, 104, and 105, would create categorical exclusions for various forest management activities, potentially eliminating public participation and undermining sound science. Biber urged the Subcommittee to start anew and prioritize public participation, scientific information, and accountability in addressing National Forest challenges.
