Summary

The Office of Natural Resources Revenue (ONRR) issues determinations on royalty payments, which are binding on ONRR and delegated states, but not on the recipient. These determinations can be modified or rescinded by ONRR or the Assistant Secretary. The recipient can appeal an order requiring royalty payment under 30 CFR part 1290. ONRR may use applicable criteria in making determinations and generally will not retroactively modify or rescind a determination unless there was a misstatement of material facts or new facts are materially different. Certain information submitted to ONRR may be exempt from disclosure and kept confidential. Nominal fees are required for state, tribal, or local government lessees using geothermal resources for public purposes. Subpart J prescribes procedures for establishing the value of coal from Indian Tribal and allotted leases for royalty purposes.
