Article 5.1: Definitions
- Exporter: an exporter in a Party's territory who maintains records on exportations.
- Identical goods: goods with the same physical characteristics, quality, and reputation.
- Importer: an importer in a Party's territory who maintains records on importations.
- Value: the value of a good or material for customs duties or origin purposes.

Article 5.2: Claims for Preferential Tariff Treatment
- An importer may claim preferential tariff treatment based on a certification of origin.
- The importing Party may require documents to support the certification and establish conditions for the importer.
- A certification of origin must contain minimum data elements, describe the good, and meet Uniform Regulations requirements.

Article 5.3: Basis of a Certification of Origin
- A producer may certify the origin of a good based on information and documents.
- An exporter may certify the origin based on information, documents, or reasonable reliance on the producer's representation.
- An importer may certify the origin based on information and documents.
- A certification of origin may apply to a single shipment or multiple shipments of identical goods.

Article 5.4: Obligations Regarding Importations
- The importer must make a statement based on a valid certification of origin and have the certification in their possession.
- The importer must provide a copy of the certification of origin upon request and demonstrate the good's origin if required.
- If the certification is based on incorrect information, the importer must correct the importation document and pay any duties owing.
