Summary

Il Consiglio di Stato ha stabilito che non sussiste un obbligo per l'Amministrazione di provvedere rispetto alle istanze di riesame di atti sfavorevoli precedentemente emanati, salvo eccezionali casi di autotutela doverosa per espressa disposizione di legge o per conclamate e rilevanti esigenze di equità e giustizia. Ciò discende dalla natura officiosa e ampiamente discrezionale del potere di autotutela e dal fatto che il privato può avanzare solo mere sollecitazioni o segnalazioni prive di valore giuridicamente cogente. La lettera dell'art. 21 nonies della l. n. 241/1990 prefigura l'iniziativa di annullamento dell'atto in termini di mera "possibilità", confermando questo principio.
