Summary

The Town and County review proposed conditional use applications for compatibility with surrounding properties, and the burden of proof is on the applicant to provide "substantial evidence" to demonstrate that the proposed land use can coexist in harmony with the neighborhood. To apply for a conditional use permit, applicants must submit required information, including a letter explaining how the eight standards of obtaining a CUP are being met, a narrative on operations, site plan/operations plan, neighborhood map, building plans, and other information. The eight standards include not being detrimental to the neighborhood, not impairing the use and enjoyment of other properties, not impeding normal development, having adequate utilities and improvements, providing adequate ingress/egress, conforming to regulations, being consistent with comprehensive plans, and meeting additional standards in Farmland Preservation Areas if applicable. The conditional use process takes approximately three months and involves review by both the Town and County.
