Summary

Policymakers need to devise public policies conducive to sustainable development and strengthen existing investment policy frameworks. The reform of international investment agreements (IIAs) has made significant progress, with countries adapting and adopting UNCTAD's 10 policy options for phase 2 of IIA reform. Recent developments show that 27 of 29 IIAs concluded in 2018 contain at least six reform features, including preservation of regulatory space and improvements to investment dispute settlement. However, much remains to be done, with the stock of old-generation treaties being 10 times greater than modern, reform-oriented treaties, and investors continuing to resort to old-generation treaties in dispute settlement cases.
