Unabhängige Berater dürfen keine Provisionen oder Vorteile von Dritten annehmen und müssen eine ausreichende Palette von Finanzinstrumenten anbieten. Portfolioverwalter dürfen ab 2018 keine Provisionen von Dritten entgegennehmen, außer in Ausnahmefällen. Es gibt eine Pflicht zur Kostentransparenz, und Berater müssen Kunden schriftliche Eignungserklärungen übermitteln. MiFID II bringt auch die Pflicht zur Aufzeichnung von Telefongesprächen und zur Produktüberwachung. Die FMA wird neue Aufsichtsbefugnisse zur Produktintervention erhalten, um die Vermarktung oder den Verkauf von Produkten oder Finanztätigkeiten zu beschränken oder zu verbieten.
