Summary

The bills require social media platforms to verify the age of every user and obtain parental consent for minors, effectively abolishing online anonymity. This mandate is unconstitutional, as it violates the First Amendment rights of both minors and adults. The Supreme Court has recognized that government regulation of access to social media implicates the First Amendment, and requiring parental consent for minors to use social media precludes them from participating on platforms, violating their First Amendment rights. Mandating age verification also violates adults' First Amendment rights to access lawful content anonymously. Similar laws have been struck down by courts in the past, and these bills will have far-reaching, unconstitutional effects beyond Utah's borders.
