Independent family councils provide confidentiality and an avenue for advocacy, as intended by federal and state laws. The goals of family councils include advocating for residents, supplementing activities programs, and educating members on long-term care issues. Massachusetts law, effective July 1, 2004, expands upon federal legislation to strengthen the ability of nursing home family councils to advocate for residents, incorporating federal regulations and adding new rights and facility responsibilities. Key rights and responsibilities include the right to meet in private, receive mail, and accept help from outside organizations, as well as facility responsibilities to provide private meeting space, designate a staff person to assist the council, and respond to written requests within 5 business days. Penalties for non-compliance include civil penalties imposed by the Department of Public Health.
