The Japan Bioindustry Association (JBA) submitted its views on Article 10 of the Nagoya Protocol, stating that it has been unable to identify situations where it is not possible to grant or obtain prior informed consent for genetic resources and associated traditional knowledge. The JBA believes that the Protocol is not retroactive and does not apply to genetic resources beyond national jurisdiction. It also suggests that cases where prior informed consent is not possible should be considered as needing capacity building, and that the decision to require prior informed consent is a sovereign right of each party. The JBA recommends that the Conference of the Parties serving as the meeting of the Parties to the Nagoya Protocol (COP-MOP) should discuss the need for a Global Multilateral Benefit-Sharing Mechanism (GMBSM) for situations where prior informed consent is not possible.
