Summary

The Competitive Enterprise Institute (CEI) submits comments on the Federal Aviation Administration's (FAA) proposed rulemaking for small unmanned aircraft systems (sUAS). CEI argues that the FAA's reliance on Section 333 of the FAA Modernization and Reform Act of 2012 is unclear and that the agency should explain its basis for this rulemaking. CEI also criticizes the FAA's proposed rules for prohibiting beyond-visual-line-of-sight (BVLOS) operations and sense-and-avoid automated operations, which could limit the potential commercial uses of sUAS. CEI recommends that the FAA adopt a risk-based, technology-neutral approach to safety regulation to promote sUAS innovation and national airspace system integration.
