Summary

As of 1 January 2021, amendments to the Polish Civil Code and the Act on Consumer Rights introduce a new category of "quasi-consumer," a natural person conducting business activity who concludes a contract directly related to their business activity but not of a professional nature. Quasi-consumers will have wider rights under sales warranty, protection against unlawful clauses, and a statutory right to rescind certain contracts. Businesses must adapt their contract documents within three months to comply with the new regulations, including auditing contractual documentation to regulate warranty rights, remove unlawful clauses, and inform quasi-consumers of their right to rescind contracts.
