BGH, Urteil vom 15. Mai 2018 - 1 StR 159/17: Die Entscheidung betrifft ein Verfahren wegen bandenmäßiger Umsatzsteuerhinterziehung. Der BGH stellt fest, dass Taten im Sinne des § 370 Abs. 1 AO, zu deren fortgesetzter Begehung sich eine Bande verbunden hat, auch mit bedingtem Vorsatz begangene Verkürzungen von Umsatz- oder Verbrauchssteuern sein können. Der Vorsteuerabzug kann versagt werden, wenn aufgrund objektiver Umstände feststeht, dass dieses Recht in betrügerischer Weise geltend gemacht worden ist. Ein ermittlungstaktisches Zuwarten der Ermittlungsbehörden begründet keinen Vertrauensschutz. Die Versagung des Vorsteuerabzugsanspruchs kann auf das Wissen sonstiger Mitarbeiter der Gesellschaft gestützt werden. Das Verhalten der Ermittlungs- und Finanzbehörden hat keinen Einfluss auf den Strafausspruch. Eine strafmildernd gewertete Erwägung des Versagens von Kontrollinstanzen ist zulässig, wenn das Versagen der Kontrollinstanzen die zu überwindende relativ niedrige Hemmschwelle belegt.
