Summary

The Independent Public Services Pensions Commission recommended changes to public sector pension schemes, including adopting Career Average Revalued Earnings (CARE) schemes. The government introduced new schemes in April 2015, but members within 10 years of their Normal Pension Age on 31 March 2012 were protected and remained in their old schemes. Employment Tribunal claims by judges and firefighters found the transitional protection arrangements discriminatory on grounds of age. The government announced that the difference in treatment would be addressed across all main public service pension schemes. Initial case management hearings have been held, and interim or final declarations have been made, entitling claimants to remain in their pre-2015 pension schemes. The government will make changes for non-claimants who suffered discrimination, allowing them to choose between their old and new schemes. Technical discussions are underway to inform a public consultation on a preferred option. All members with relevant service will be eligible for changes to their pension entitlements, and legislation will be required before changes can be made.
