Summary

The Employment Development Department (EDD) can file a Notice of State Tax Lien for unpaid contributions, interest, penalties, and costs. A State Tax Lien is a perfected and enforceable lien on all property and rights to property, and is filed to protect the State of California's interest. The lien is valid for 10 years and may be extended in 10-year increments. Employers who fail to file and pay liabilities timely are subject to the filing of a Notice of State Tax Lien, which can adversely affect their credit rating and credit reports. To release a lien, the liability must be paid in full with certified funds, and a Release of Lien will be mailed to the County Recorder office and the Secretary of State within 40 days.
