The CMA's jurisdiction over NHS mergers derives from the Enterprise Act 2002, and its role is restricted to mergers involving foundation trusts, which have been granted increased operational autonomy. The NHS Long Term Plan proposes to remove the CMA's duties to intervene in NHS provider mergers, and the CMA does not oppose this, but notes that its jurisdiction derives from the Enterprise Act 2002, not the Health and Social Care Act 2012.
