Summary

The Treasury Ministerial Directive to the Overseas Investment Office aims to provide direction and guidance on the Government's general policy approach to foreign investment in sensitive assets. The new Ministerial Directive Letter raises the bar for overseas investment in rural land and sets an expectation that migrants should already hold a relevant visa and have plans to move to New Zealand within 12 months for residency-based applications. The letter outlines the Government's policy towards overseas investment, direction to the Overseas Investment Office on assessing applications, and approach to the acquisition of special land. The existing 'large farm' directive has issues, including only applying to very large tracts of farm land, not covering land uses like forestry, and encouraging intensification of farm land. The new Directive Letter will replace the existing one issued in 2010 and provide more certainty to overseas investors considering investing in New Zealand's sensitive assets.
