Summary

The Supreme Court recognizes social media sites as important venues for users to exercise free speech rights protected under the First Amendment. However, commentators and legislators question whether these platforms are living up to their reputation as digital public forums, citing concerns over violent or false speech and unfair banning or restriction of valuable speech. Federal law offers little recourse for users challenging social media providers' content decisions, with courts holding that the First Amendment is not implicated by private companies' actions and that Section 230 of the Communications Decency Act provides immunity for hosting or removing content. Some argue Congress should regulate social media sites, but government action may implicate the First Amendment, and social media providers may argue that regulations infringe on their own free speech rights. There are three possible frameworks for analyzing governmental restrictions on social media sites' ability to moderate user content: treating social media sites as state actors, as special industries like common carriers or broadcasters, or as news editors with full First Amendment protections.
