Summary

The Supreme Court of New Zealand allowed the appeal by the Minister of Justice and the Attorney-General, setting aside the Court of Appeal's decision and reinstating the Minister's 2016 decision to surrender Kyung Yup Kim to the People's Republic of China to face trial for intentional homicide. The Court found that the responses provided by the PRC Government satisfactorily addressed the outstanding issues regarding the risk of torture and unfair trial, and that there were no substantial grounds to believe that Mr Kim would be at risk of torture or an unfair trial if surrendered. The Court also considered Mr Kim's health and the age of the case, but found that they were not sufficiently extraordinary or compelling to prevent extradition. Costs were reserved.
