Summary

The Charlotte-Mecklenburg Schools voluntarily agreed to take actions to ensure compliance with Section 504 of the Rehabilitation Act of 1973 and its implementing regulation, and Title II of the Americans with Disabilities Act of 1990 and its implementing regulation. The District reaffirms its commitment to ensure people with disabilities have an equal opportunity to participate in its programs, benefits, and services, including those delivered through electronic and information technology.

The District will measure the accessibility of online content and functionality according to the W3C's Web Content Accessibility Guidelines (WCAG) 2.0 Level AA and the Web Accessibility Initiative Accessible Rich Internet Applications Suite (WAI-ARIA) 1.0.

Proposed policies and procedures for new online content and functionality must ensure accessibility, except where doing so would impose a fundamental alteration or undue burden. The District will submit proposed policies and procedures for review and approval by December 22, 2016.

The District will provide equally effective alternative access for individuals with disabilities, without resulting in a fundamental alteration or undue burden. The District will also adopt and fully implement amended policies and procedures within 60 days of receiving OCR's approval.

The District will audit its existing content and functionality on its website, including the home page, subordinate pages, and intranet pages and sites, to identify any online content or functionality that is inaccessible to persons with disabilities. The audit will use the Benchmarks for Measuring Accessibility set out above, unless the District receives prior permission from OCR to use a different standard as a benchmark.

The District will submit the bona fides of its proposed Auditor to OCR for review and approval by October 24, 2016. The District will also submit a description of how the proposed Auditor will be used to develop a Proposed Corrective Action Plan within five months of receiving OCR's approval.
