Summary

The Fair Labor Association (FLA) investigated a complaint against C.S.A. Guatemala Sociedad Anónima, a factory in Guatemala City, alleging worker rights violations, including freedom of association, abusive treatment, forced overtime, and failure to pay wages and benefits. The complaint was filed by the Ad Hoc Committee of United Workers of the factory. FLA-affiliated companies Nike and Delta Apparel sourced from the factory at the time. The investigation found that management had dismissed 20 workers who attempted to form a union, and although some remediation actions were taken, including an agreement to reinstate the workers, they did not return to their jobs. The factory has since developed a remediation plan, including creating policies and procedures to allow workers to establish and join organizations without retaliation, and providing training for managers and supervisors on freedom of association and grievance systems.
