Summary

The Illegal Migration Bill 2023 is considered incompatible with the UK's international obligations under various conventions, including the 1951 Refugee Convention, the European Convention on Human Rights, and the Convention Against Torture. The Bill seeks to undermine domestic safeguards against arbitrary detention and curtail the courts' constitutional role, violating international law and the separation of powers. If enacted, the Bill would effectively extinguish the right to seek asylum in the UK, reversing the Refugee Convention's rationale and creating serious risks of removal contrary to human rights and international law. The Bill's regime would catch most asylum seekers, blocking access to asylum in the UK without guaranteeing access elsewhere, and breaches Article 31 of the Refugee Convention by penalizing unlawful arrivals.
