Summary

Australian Lawyers for Human Rights (ALHR) submits to the Parliamentary Joint Committee on Intelligence and Security that the Foreign Influence Transparency Scheme Bill 2017 is excessively far-reaching and undermines the role of charities and non-government organisations in supporting Australia's democracy. ALHR's primary concern is that the Bill, in combination with other related Bills, will violate fundamental human rights to freedom of speech and expression, and severely restrict the implied Constitutional right to free political communication. The Bill imposes strict liability penalties for non-business interests, while providing light regulation for business interests, and contains key terms with excessively broad meanings. ALHR opposes the Bill's provisions, including the imposition of strict liability and excessive penalties, and believes that the combined effect of the provisions is counterproductive and highly dangerous in terms of the rule of law.
