Section 321 of the Tariff Act of 1930 authorizes CBP to provide an administrative exemption for shipments with an aggregate fair retail value of $800 or less, known as a de minimis entry. CBP has created Section 321 programs to monitor and protect against illegitimate trade while providing duty-free shipments for qualified imports. The agency is conducting a voluntary pilot to test the utility of accepting advance data from e-commerce supply chain partners and a voluntary test of a Section 321 de minimis commercial entry process through the creation of the new Entry Type “86”. The pilot and test aim to identify high-risk shipments, expedite low-risk shipments, and provide greater visibility into the de minimis universe. Participants include carriers, brokers, freight forwarders, and online marketplaces, with the pilot limited to 9 participants and the test open to all customs brokers and self-filers.
