Summary

The Centers for Medicare & Medicaid Services (CMS) used appropriated funds to produce and distribute video news releases (VNRs) that were not attributed to CMS, violating the restriction on using appropriated funds for publicity or propaganda purposes in the Consolidated Appropriations Resolution of 2003. The VNRs consisted of prepackaged news reports, video clips, and introductory and concluding slates with facts about the Medicare Prescription Drug, Improvement and Modernization Act of 2003, but did not identify CMS as the source of the news reports. This violated the Antideficiency Act, and CMS must report the violation to Congress and the President.
