Summary

The Mental Healthcare Act, 2017, aims to provide mental healthcare and services for persons with mental illness, protecting, promoting, and fulfilling their rights during delivery of mental healthcare and services. India signed and ratified the Convention on Rights of Persons with Disabilities in 2007, and this Act aligns and harmonizes existing laws with the Convention. The Act extends to the whole of India and came into force on a date appointed by the Central Government. It defines various terms, including "advance directive," "appropriate Government," "Authority," "care-giver," and "mental health establishment," and provides for the rights of persons with mental illness, including the right to access mental healthcare and treatment, and the right to make an advance directive.
