El Real Decreto 401/1996, de 1 de marzo, establece las condiciones para la introducción en el territorio nacional de determinados organismos nocivos, vegetales, productos vegetales y otros objetos con fines de ensayo, científicos y para la actividad de selección de variedades. El decreto fija las condiciones para garantizar que no exista riesgo de propagación de organismos nocivos y establece los requisitos previos para la solicitud de autorización de las actividades, incluyendo la indicación de los datos mínimos necesarios, como el nombre y dirección de la persona responsable, el tipo y cantidad de material, el lugar de origen y el método de destrucción o tratamiento del material propuesto. La autorización de las actividades corresponde a la Comunidad Autónoma correspondiente, que deberá comunicarla a la Dirección General de Sanidad de la Producción Agraria del Ministerio de Agricultura, Pesca y Alimentación.
