Summary

California law, enacted in 1975, limits transit operator purchases of buses to those with a gross axle weight not exceeding 20,500 lbs on any axle. However, many buses operated in the state exceeded this limit, prompting local enforcement issues and legislative action.

Assembly Bill 1706 (2012) introduced regulations considering vehicle weight impacts, and Assembly Bill 1250 (2015) significantly amended these requirements:

- Curb Weight Limit: The new law defines the axle weight limit as curb weight (maximum fuel, oil, and coolant but excluding passenger and driver weight), not gross weight.
- Updated Limits by Axle and Bus Type:
- Transit Buses (except zero emission buses): 23,000 lbs (2016-2018), 22,000 lbs (2019 onwards).
- Articulated and Zero Emission Transit Buses: 25,000 lbs (2016-2017), 24,000 lbs (2018-2019), 23,000 lbs (2020-2021), 22,000 lbs (2022 onwards).

An analysis of 21 transit buses tested from 2011 to 2015 reveals:

- Only one bus met the former 20,500 lbs limit.
- All buses, including zero emission models, meet the new curb weight limits.
- The New Flyer XE40 (Bus #3) exceeds the 2019 limit by 220 lbs.
