Summary

This act repeals the termination date of certain provisions requiring health maintenance organizations (HMOs) to pay nonparticipating providers for certain services at specific rates. HMOs must pay nonparticipating providers within 30 days of receiving a claim. Payment rates vary: hospitals are paid the rate approved by the Health Services Cost Review Commission; trauma physicians are paid at least 140% of the Medicare rate or the rate paid by the HMO in 2001; and other providers are paid at least 125% of the average rate paid by the HMO to similar providers under contract, or 140% of the Medicare rate, inflated by the Medicare Economic Index. HMOs must disclose reimbursement rates to nonparticipating providers upon request.
