The Government has introduced a new Permitted Development Right (PDR) allowing change of use from Class E premises (office, retail, café/restaurant, indoor fitness) to residential use, subject to prior approval, effective 1 August 2021. Prior approval is required for flooding, noise, natural light, and impact on Conservation Areas and local services. Restrictions apply, including a 1,500 sq m size limit, 2-year Class E use, and 3-month vacancy. The new PDR does not apply to listed buildings, national parks, or Areas of Outstanding Natural Beauty. In Central London, the new PDR applies in Conservation Areas, but the Central Activities Zone is exempt due to an Article 4 direction, which will be extended until 1 August 2022. Local planning authorities (LPAs) can make new Article 4 directions to prevent change of use, but these are subject to approval by the Secretary of State. The 1,500 sq m size restriction may limit the utility of the new right, especially for large-scale office conversions.
