ARTICLE 1. MAINTENANCE OF STANDARDS
The Employer agrees to maintain all conditions of employment at not less than the highest standards
in effect at the time of the signing of this Agreement, except as specifically limited elsewhere in this
Agreement. The conditions of employment shall be improved whenever specific provisions for
improvement are made elsewhere in this Agreement. The Local Unions shall identify and reduce to
writing specific local standards and conditions practiced under this Article and submit them to the
appropriate Regional Joint Grievance Committee.

ARTICLE 2. SAFETY AND HEALTH
The Employer agrees to comply with all applicable federal, state and local regulations pertaining to
worker safety and health. Grievances pertaining to Safety and Health shall be heard at the first (1st)
step local level. The Employer agrees to maintain a clean and well lighted work area for all employees
covered by this Operational Supplement. An employee who is injured on the job shall receive pay at
the applicable hourly rate for the balance of his/her regular shift on that day. Employees who sustain
occupational injury or illness shall be allowed to select a physician of their own choice.

ARTICLE 3. SUBCONTRACTING AND WORK PRESERVATION
The Employer agrees to preserve and protect bargaining unit work. The Employer shall not
subcontract or divert work presently performed by, or hereafter assigned to, its employees to non-
employee owner-operators or other business entities owned and/or controlled by the signatory
Employer, or its parent, subsidiaries or affiliates, except as specifically set forth in writing herein or in
any Supplement or Rider. The parties agree that for purposes of this Article it shall be presumed that a
diversion of work in violation of this Operational Supplement occurs when work presently and
regularly performed by, or hereafter assigned to, employees of the Employer covered by this
Operational Supplement has been lost and the lost work is being performed by an entity owned and/or
controlled by the signatory Employer, its parent, or a subsidiary. The burden of overcoming such
presumption in the grievance procedure shall be upon the Employer.
