Summary

Brazil's 1988 Federal Constitution established the right to health as a universal right, leading to the creation of the Unified Health System (SUS), which aims to provide universal access to health services. The National Medicines Policy and Act 9.313/96 guarantee access to treatment, including antiretrovirals (ARV) and medicines for opportunistic infections. However, Brazil's compliance with TRIPS in 1996 led to the granting of patents for pharmaceuticals, increasing treatment costs. Despite incorporating TRIPS flexibilities like compulsory licensing, its implementation was slow, and only in 2007 was it fully implemented. Civil society has supported the use of compulsory licensing to overcome sustainability threats imposed by high medicine costs, but its use has been limited, with the government often negotiating prices with pharmaceutical companies instead.
