Summary

Assessments are paid quarterly and penalties apply for late payment. The fund's liabilities must be fully funded, and excess assessments are refunded to employers on a pro rata basis. Claims are maintained pursuant to KRS 342.732, and the fund is only liable for employees of coal severance or processing employers. Assessments cease once the fund's liabilities are fully funded.
