Summary

California law prohibits discrimination, harassment, and retaliation, and requires employers to take reasonable steps to prevent and correct wrongful behavior. An effective anti-harassment program includes a clear written policy, buy-in from top management, training for supervisors and managers, specialized training for complaint handlers, and prompt and fair investigations and remedial action. If a report of harassment is received, it should be given top priority and investigated promptly and fairly, with consideration of due process and confidentiality. The investigation should involve interviewing the complaining party, the accused party, and relevant witnesses, and reviewing relevant documents. Confidentiality is limited, and employers can only promise to keep information confidential to the extent necessary to conduct the investigation and take appropriate action. The investigation should be started and conducted promptly, and concluded quickly, while ensuring fairness and thoroughness.
