Summary

The Article 29 Data Protection Working Party provides guidance on the principle of purpose limitation, which protects data subjects by limiting how data controllers use their data. The principle has two building blocks: personal data must be collected for "specified, explicit and legitimate" purposes and not be "further processed in a way incompatible" with those purposes. Compatibility is assessed on a case-by-case basis, considering factors such as the relationship between purposes, context, nature of data, and safeguards adopted by the controller. Processing incompatible with specified purposes is prohibited, and the principle can only be restricted under certain conditions. The Working Party recommends deleting a proposed exception in the Data Protection Regulation and adopting a list of relevant factors to assess compatibility.
