Summary

The Emergency Powers Act [Chapter 11:04] allows the President to make regulations for the protection of the community during a state of emergency, including the power to arrest, detain, or restrict movement, and to regulate essential services, trade, and business. The Act also provides for the preventive detention of individuals in the interests of defense, public safety, or public order, and empowers the President to make regulations for the treatment and discipline of detained persons. Any regulations made under the Act take effect notwithstanding any inconsistent laws, and may be amended, suspended, or modified as necessary. The Act also provides for the revival of laws that have been amended, suspended, or modified by regulations made under the Act, once the regulations expire or are repealed.
