Summary

Der Deutsche Bundestag hat einen Gesetzentwurf zur Änderung des Völkerstrafgesetzbuches (VStGB) vorgelegt, um die Strafverfolgung von Verbrechen der Aggression durch deutsche Behörden zu ermöglichen. Der Entwurf sieht die Einführung eines eigenständigen Straftatbestands der Aggression in das VStGB vor, der die bisherigen §§ 80 und 80a des Strafgesetzbuches (StGB) ersetzen soll. Die Formulierung des Tatbestands und der Bedingungen für dessen Verfolgung sollen in enger Anlehnung an die Beschlüsse von Kampala und das zugrunde liegende Völkergewohnheitsrecht erfolgen. Der Gesetzentwurf soll die Verwirklichung des Grundsatzes der Komplementarität nach dem Römischen Statut des Internationalen Strafgerichtshofs unterstützen.
