Summary

The Stafford Act declaration process is made solely at the discretion of the President of the United States. The Governor of the affected State or Tribal Chief Executive must submit a request for a declaration, which includes a Preliminary Damage Assessment (PDA) to determine the extent of the disaster. The request must show that the disaster is beyond the capabilities of the State and local governments or Indian tribal government and that supplemental federal assistance is necessary. There are two types of disaster declarations: emergency declarations and major disaster declarations, which authorize the President to provide supplemental federal disaster assistance. Emergency declarations are used for occasions when federal assistance is needed, with a total amount of assistance not exceeding $5 million, while major disaster declarations are used for more severe disasters.
