Summary

The Board of Governors of the Federal Reserve System and the Federal Deposit Insurance Corporation are adopting a final rule to implement the requirement in the Dodd-Frank Wall Street Reform and Consumer Protection Act regarding resolution plans for nonbank financial companies and bank holding companies with assets of $50 billion or more. The rule requires these companies to submit plans for rapid and orderly resolution in the event of material financial distress or failure. The plans must include information on the company's structure, assets, liabilities, and contractual obligations, as well as a strategic analysis of how the company can be resolved under the Bankruptcy Code without posing systemic risk to the financial system. The rule is effective November 30, 2011. Additionally, the Department of Agriculture is amending 7 CFR part 984 to establish an assessment rate of $0.0175 per kernelweight pound for California merchantable walnuts, effective September 1, 2011.
