Summary

The Secretary amends the regulations implementing the Family Educational Rights and Privacy Act (FERPA) to implement sections 951 and 952 of the Higher Education Amendments of 1998 (HEA). The amendments permit postsecondary institutions to disclose certain information to the public and to parents of students. The regulations are effective August 7, 2000. The amendments include a list of crimes of violence and non-forcible sex offenses, and clarify when results become "final" and what categories of information may be disclosed under this provision. The final regulations have significant changes from those proposed in the notice of proposed rulemaking (NPRM). The Secretary has provided more detail regarding the crime of violence provision and clarified when results become "final" and what categories of information may be disclosed under this provision. The amendments also permit non-consensual disclosure of the final results of a disciplinary proceeding against a postsecondary student in specified circumstances. The amendments also permit non-consensual disclosure to parents and legal guardians of students under the age of 21 of information regarding a student's violation of laws or policies governing the use or possession of alcohol or a controlled substance. The final regulations do not require transmission of information that any other agency or authority of the United States gathers or makes available.
