Parents and eligible students have rights under FERPA, including:
1. Inspecting and reviewing education records within 45 days of request.
2. Requesting amendment of inaccurate or misleading records.
3. Providing written consent before disclosing personally identifiable information (PII), except in certain cases, such as disclosure to school officials with legitimate educational interests.
4. Filing a complaint with the U.S. Department of Education for alleged FERPA non-compliance.
Schools may disclose PII without consent in cases such as:
- Disclosure to other school officials with legitimate educational interests
- Disclosure to officials of another school where the student seeks or intends to enroll
- Disclosure to authorized representatives of the U.S. Comptroller General, U.S. Attorney General, or U.S. Secretary of Education
- Disclosure in connection with financial aid or studies
- Disclosure to accrediting organizations or parents of dependent students
- Disclosure to comply with a judicial order or lawfully issued subpoena
- Disclosure in connection with a health or safety emergency
- Disclosure of directory information.
