Fireworks Regulation Bylaw For The Town Of Rocky Mountain House.pdf

Purpose: To govern the sale, possession, and use of fireworks within the Town for public safety and well-being.

Definitions:
- CAO: Chief Administrative Officer of the Town.
- Consumer Fireworks: Low-hazard fireworks designed for recreational use (excluding sparklers).
- Discharge: Firing, igniting, exploding, or setting off fireworks.
- Display Fireworks: High-hazard professional fireworks.
- Fire Ban: A prohibition on all burning and Discharge of fireworks issued by the Town.
- Firecracker: As defined in the National Fire Code 2019 - Alberta Edition.
- Fireworks: Consumer, Display, and Pyrotechnics (excluding firecrackers).
- Fireworks Inspector: Designated person to administer and enforce this bylaw.
- Fireworks Permit: Authorization granted by the Fireworks Inspector for Discharging fireworks at a specific location, considering safety factors like clearance, National Fire Code requirements, and other relevant considerations.
- Fireworks Supervisor: Person with a valid display supervisor certificate under the Explosives Act.
- Municipal Tag: Offence notice issued under the authority of a Town bylaw.
- Prohibited Fireworks: Firecrackers and items on the latest list of prohibited fireworks under the Explosives Act.
- Provincial Fire Administrator: Person authorized to provide written confirmation on fire discipline matters under the Safety Codes Act.
- Provincial Offences Procedure Act: Legislation governing provincial offences.
- Pyrotechnician: Person with a valid pyrotechnician certificate under the Explosives Act.
- Pyrotechnics: Special effects pyrotechnics as defined in the Explosives Regulations, 2013.
- Safety Codes Act: Legislation pertaining to safety codes.
- Violation Ticket: Notice of offence issued under the Provincial Offences Procedure Act.

Requirements:
1. Prohibits sale, display, possession, and Discharge of Prohibited Fireworks.
2. Requires a Fireworks Permit for Discharging Consumer or Display Fireworks or Pyrotechnics within the Town.
3. Enforces safe storage, handling, and Discharge of fireworks to prevent nuisances, fires, explosions, and injuries.
4. Restricts Discharging fireworks on highways, streets, parks, etc., unless authorized by a permit.
5. Allows sale and display of Consumer Fireworks in accordance with the Explosives Act.
6. Prohibits residential zone storage of Consumer Fireworks unless approved by the Fireworks Inspector.
7. Sets age restrictions for selling or possessing fireworks (majority age) and prohibits sales to individuals under 18 years old.

Permit Application:
- Applications must include a completed form, contact information, confirmation of supervisor/pyrotechnician status, property owner consent, event description, site plan, fees, liability insurance, additional permits, and any other required information.

Issuance and Refusal:
- The Fireworks Inspector issues permits upon meeting all requirements.
- Permits may include terms and conditions to ensure safety and environmental protection.
- The Inspector can refuse, suspend, or cancel permits if there's a substantial risk, non-compliance with requirements, incorrect/insufficient information, or other relevant factors.
