The Environmental Protection Agency (EPA) has issued a final rule for the management of hazardous waste pharmaceuticals by healthcare facilities and reverse distributors, effective August 21, 2019. The rule prohibits disposal of hazardous waste pharmaceuticals down the drain, eliminates dual regulation of RCRA hazardous waste pharmaceuticals that are also DEA controlled substances, and maintains the household hazardous waste exemption for pharmaceuticals collected during take-back programs. The rule also excludes certain FDA-approved over-the-counter nicotine replacement therapies from regulation as hazardous waste and establishes a policy on the regulatory status of unsold retail items managed via reverse logistics.
