The European Commission's copyright reform has not met its promises to reduce differences between copyright regimes and provide greater legal certainty for cross-border use. The current proposal for educational uses, article 4, allows licensing mechanisms to override exceptions, increasing transaction costs and legal uncertainty. A recent study shows that licenses restrict educational exceptions, grant questionable rights to rightsholders, and impose burdensome obligations on schools. The proposed education exception will not facilitate cross-border use due to its limited scope. The COMMUNIA Association urges MEPs to support a mandatory exception for non-commercial education that facilitates cross-border sharing without licenses or compulsory remuneration, by rejecting proposals to exclude textbooks, mandatory remuneration, license priority, and ensuring contractual provisions that restrict the exception are unenforceable, and enabling cross-border use between educational establishments.
