Summary

FIFRA Section 25(b) exempts certain products from federal registration, but they are subject to state registration. The Association of American Pesticide Control Officials (AAPCO) created a 25(b) Workgroup to help companies comply with state regulations. The workgroup established label guidance, including 12 expectations:
1. Compliance with 6 EPA conditions: active ingredients, inert ingredients, ingredient listing, health-related claims, company name and contact information, and label statements.
2. Signal Word and Keep Out of Reach of Children statement on the front panel.
3. Active and inert ingredients listed in column form, totaling 100%.
4. Inert ingredients listed in order of highest percentage.
5. No images of children on labels, except for products intended for use on children or swimming pools.
6. Website claims must comply with EPA conditions.
7. Labels must include specific use site locations.
8. Non-toxic claims are not acceptable.
9. "Organic" or "Certified Organic" claims are unacceptable, except in specific contexts.
10. "Natural" claims are not allowed if the product includes synthetic chemicals.
11. "Safe" claims require the qualifier "...when used as directed".
12. Data may be required to substantiate label claims.
