Summary

Das Bundesministerium der Justiz und für Verbraucherschutz hat eine Stellungnahme zum Entwurf des Gesetzes zur Anpassung des Datenschutzrechts an die Verordnung (EU) 2016/679 (Datenschutz-Grundverordnung) und zur Umsetzung der Richtlinie (EU) 2016/680 abgegeben. Die Stellungnahme kritisiert den Regelungsansatz des Entwurfs, der die Umsetzung der Datenschutz-Richtlinie und die Anpassung des deutschen Datenschutzrechts an die DS-GVO in einem Gesetz vorsieht. Das Ministerium hält dies für nicht verständlich und problematisch, da der Anwendungsbereich von Norm zu Norm wechselt und der Normanwender selbst entscheiden muss, ob er unter die DS-GVO, die Datenschutz-Richtlinie oder keine der beiden Regelungen fällt.

Das Ministerium fordert eine getrennte Regelung der Anpassung an die DS-GVO und der Umsetzung der Datenschutz-Richtlinie in zwei separaten Kapiteln. Es kritisiert auch die umfangreichen Wiederholungen von Regelungen der DS-GVO im Entwurf, die europarechtlich problematisch seien.

Das Ministerium verweist auf Regelungslücken im Bereich der Datenschutz-Richtlinie, insbesondere bei Regelungen zum Schadensersatz, den Betroffenenrechten und der Auftragsdatenverarbeitung. Es fordert eine Ergänzung des Entwurfs, um diese Lücken zu schließen!
