Summary

Italy's 'hate speech' issue is growing due to migrant and refugee integration struggles, incendiary political tones, and biased media reporting. Despite robust freedom of expression and equality protection in Italian law, the legal framework on 'hate speech' doesn't fully comply with international human rights standards. Protected characteristics in criminal law are limited to race, ethnic origin, nationality, or religion, and proposals to expand protection have stalled. Italian courts inconsistently apply and interpret 'hate speech' provisions, and victims can initiate criminal or civil proceedings. Two equality institutions, UNAR and OSCAD, monitor and counter 'hate speech' through positive measures. Relevant laws respond to 'hate speech' in the media, promoting diversity and inclusion, but the Italian Communications Regulatory Authority (AGCOM) has limited powers to intervene and issue sanctions, particularly regarding online content.
