Summary

The Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA) requires that financial requirements and treatment limitations for mental health or substance use disorder benefits be no more restrictive than those for medical/surgical benefits. The 21st Century Cures Act requires the Departments of Labor, Health and Human Services, and the Treasury to issue guidance on disclosure and nonquantitative treatment limitation (NQTL) requirements. The Departments have issued FAQs and guidance documents to help implement MHPAEA, including a self-compliance tool, action plan, and model disclosure request form. The FAQs provide examples of how MHPAEA applies to different fact patterns, and the Departments intend to continue providing additional implementation information on a rolling basis.
